Following extensive studies conducted by the EFSA (European Food Safety Authority) and concluded with the report of 13 April 2010 on the melamine in food , the European Commission has proposed an amendment of the new Regulation 10/2011 on plastic materials intended to come in contact with food.
The specific migration limit of melamine, as stated in the proposed amendment, would be lowered from the current 30 mg per kg of food to 2.5 mg per kg of food, in consideration of a legislative alignment with the parameters already established for products containing milk and its derivatives from China.
The new requirements, if the proposal is confirmed, will be applied from 1st January 2012 but the articles legally placed on the market before this date could be selled until 1st January 2013.
The issue of melamine had been treated recently by the German institute for risk assessment of BFRs and in 2010 specifically addressed by the European Union.
Even the latest measures adopted by Europe to articles intended for food contact and from China [Regulation 284/2011] focused attention on potential risks to the consumer.
The draft called SANCO/11620/2011 (POOL/E6/2011/11620/11620-EN) also introduces 15 new substances and corrects some mistakes on the list of approved substances.
